CRIME SCENE CLEAN UP AWARDS GUIDELINE EFFECTIVE 11/1/09 AUTHORITY states allowable expenses include reasonable costs associated with crime scene clean up. 21 O.S. 142.13 Biohazard Clean Up Safety Training states that reasonable costs associated with crime scene clean up shall not exceed $2,000.00. 

The definition of collateral sources found in 21 O.S. 142.3(3)h includes proceeds of any contract of insurance payable to the claimant for loss which the victim sustained because of the criminally injurious conduct. Biohazard Clean Up Safety Training Such definition would include proceeds from homeowners insurance. POLICY This policy covers claims decided on or after November 1, 2009. 

Crime scene clean up is a compensable benefit payable to an eligible victim or claimant for cleaning a crime scene if the loss was not compensated through a collateral source, up to $2,000.00. Biohazard Clean Up Safety Training The intent of awarding compensation for crime scene clean up is to minimize the trauma of the crime for the victim and family members. 

It is not the  intent of this benefit to restore the crime scene to its original condition. Biohazard Clean Up Safety Training The Oklahoma Crime Victims Compensation Board interprets cleaning and making the crime scene safe as reasonable to the victim or claimant. 

The purpose of this document is to state the Board’s criteria for determining crime scene clean up as a pecuniary loss, including: definitions; who is eligible; what expense are covered; procedures; and costs not covered. Biohazard Clean Up Safety Training DEFINITIONS "Cleaning the crime scene” means: 

The professional cleaning, disinfecting, and removal or attempted removal of all items contaminated by blood or other bodily fluids as a result of criminally injurious conduct, in order to restore the environment to a safe state. Biohazard Clean Up Safety Training This may include the removal or attempted removal of stains, odors, broken glass, and any other objects or impurities. 

WHO IS ELIGIBLE? Biohazard Clean Up Safety Training Pursuant to 21 O.S. 142.3(3), an eligible claimant is: a victim, a dependent of a victim who has died because of criminally injurious conduct or a person authorized to act on behalf of the victim or dependent of a victim. In no event shall any other person(s) be considered a claimant for the purposes of reimbursement for crime scene clean up. 

COVERED EXPENSES The costs must be an actual loss to the victim or claimant. Biohazard Clean Up Safety Training For example, if a friend or neighbor actually cleans up the scene, the cost of the supplies may be reimbursable, provided receipts for the products are provided. 

The time spent by the person performing the service may not be reimbursable because the victim would not have ordinarily been billed for this service. Biohazard Clean Up Safety Training If the victim or claimant hired a commercial firm or cleaning service to perform the service, the cost for labor is reimbursable. PROCEDURES 

In order to make an award for cleaning a crime scene, the Board and Administrator should take the following steps: determine if the claimant, as defined in 21 O.S. 142.3(3) incurred an expense for crime scene clean up; Biohazard Clean Up Safety Training review written statements and receipts outlining the services performed.

Determine compensable expenses; and require collateral sources be utilized when available. Biohazard Clean Up Safety Training The Board may require the claimant submit a notice of rejection from the insurance carrier or a notice of the deductible paid by the claimant on the insurance claim. 

If no collateral source exists, this information should be verified and clearly stated on the verification report submitted by the Victim/Witness Coordinator. Biohazard Clean Up Safety Training COSTS NOT COVERED The following costs will not be eligible for consideration: those costs which are covered by a collateral source.

Costs reimbursed by law enforcement agencies due to damage by officers responding to the call; costs paid by court ordered restitution paid directly to, Biohazard Clean Up Safety Training or on behalf of, the victim or claimant; those costs not directly billed to the victim or claimant; costs paid by business owners whose property was damaged as a result of criminally injurious conduct.

Costs for the replacement of personal property removed during the clean up process, including, but not limited to: a) the structure; Biohazard Clean Up Safety Training and b) any coating or covering in, on, or about the structure or crime scene, unless such coating and/or covering is included in the standard fee charged by a professional bio-hazard clean up company. 

Any other costs deemed unreasonable by the Crime Victims Compensation Board or Administrator.Occupational Exposure to Bloodborne Pathogens AGENCY: Biohazard Clean Up Safety Training Occupational Safety and Health Administration (OSHA), Labor ACTION: Final Rule SUMMARY: 

The Occupational Safety and Health Administration hereby promulgates a standard under section 6(b) of the Occupational Safety and Health Act of 1970 (the Act), 29 U.S.C. 655 to eliminate or minimize occupational exposure to Hepatitis B Virus (HBV), Biohazard Clean Up Safety Training Human Immunodeficiency Virus (HIV) and other bloodborne pathogens. 

Based on a review of the information in the rulemaking record, Biohazard Clean Up Safety Training OSHA has made a determination that employees face a significant health risk as the result of occupational exposure to blood and other potentially infectious materials because they may contain bloodborne pathogens, 

Including hepatitis B virus which causes Hepatitis B, a serious liver disease, and human immunodeficiency virus, which causes Acquired Immunodeficiency Syndrome (AIDS). Biohazard Clean Up Safety Training The Agency further concludes that this exposure can be minimized or eliminated using a combination of engineering and work practice controls.
